TERMS & CONDITIONS — PEAK PERFORMANCE

ARTICLE 1 — COMPANY INFORMATION
Peak Performance is an online store operated as a sole proprietorship (micro-entreprise) under French law, selling sports accessories and wellness products worldwide via its e-commerce platform.

ARTICLE 2 — SCOPE OF APPLICATION
These General Conditions of Sale apply to all orders placed on the Peak Performance website by any customer, regardless of their country of residence. By placing an order, the customer unconditionally accepts these terms and conditions in their entirety.
Peak Performance reserves the right to modify these terms at any time. The applicable conditions are those in force at the date of the order.
ARTICLE 3 — PRODUCTS
Peak Performance sells sports accessories and wellness products. Product descriptions, photographs, and technical specifications are provided for informational purposes and are as accurate as possible.
Peak Performance operates under a dropshipping model. Products are shipped directly from our suppliers to the customer. This does not affect any of the rights and guarantees offered to the customer under these terms.
Peak Performance reserves the right to withdraw any product from its catalog at any time without notice.
ARTICLE 4 — PRICES
All prices displayed on the website are in US Dollars (USD) or the currency indicated at checkout. Prices are subject to change at any time without prior notice.
The price invoiced is the price displayed at the time of order confirmation. Peak Performance is not subject to VAT collection under the French micro-enterprise regime (franchise en base de TVA), in accordance with Article 293 B of the French General Tax Code.
Any customs duties, import taxes, or local charges applicable in the customer’s country are the sole responsibility of the customer.
ARTICLE 5 — ORDER & PAYMENT
Orders are placed exclusively online via the Peak Performance website. An order is deemed confirmed once payment has been successfully processed and the customer has received a confirmation email.
Accepted payment methods: credit/debit card (Visa, Mastercard, American Express), PayPal, and any other payment methods displayed at checkout.
Peak Performance reserves the right to cancel or refuse any order in the event of suspected fraud, payment failure, or stock unavailability.
ARTICLE 6 — SHIPPING & DELIVERY
Peak Performance ships worldwide. Estimated delivery times are as follows:
• USA, Canada, Australia, UK: 7 to 15 business days
• Europe: 10 to 20 business days
• Rest of the world: 14 to 25 business days
These timeframes are estimates and may vary due to carrier delays, customs processing, or exceptional circumstances. Peak Performance cannot be held liable for delays beyond its control.
A tracking number will be provided to the customer by email once the order has been dispatched.
If a package is lost or not delivered within 30 business days of the estimated delivery date, the customer must contact our support team to initiate an investigation.
ARTICLE 7 — RETURNS & REFUND POLICY
Customers have a 14-day right of withdrawal from the date of receipt of their order, without having to provide a reason.
Conditions for return:
• The return request must be submitted within 14 days of receiving the order
• Products must be returned in their original condition, unused, and in their original packaging
• The customer is responsible for return shipping costs unless the item is defective or incorrect
• Personalized or hygiene-related products cannot be returned once opened
Once the returned item has been received and inspected, the refund will be processed within 7 to 10 business days to the original payment method.

ARTICLE 8 — DEFECTIVE OR INCORRECT PRODUCTS
If a product arrives defective, damaged, or does not correspond to the order, the customer must contact Peak Performance within 7 days of receipt with photographic evidence.
Peak Performance will offer, at its discretion: a full refund, a replacement product, or a store credit. Return shipping costs for defective items will be covered by Peak Performance.
ARTICLE 9 — LIMITATION OF LIABILITY
Peak Performance cannot be held liable for any indirect, incidental, or consequential damages arising from the use of its products. Our total liability shall not exceed the amount paid by the customer for the order in question.
Peak Performance is not responsible for delays or failures caused by events beyond its control, including natural disasters, strikes, customs delays, carrier failures, or any other force majeure event.
ARTICLE 10 — INTELLECTUAL PROPERTY
All content on the Peak Performance website, including logos, images, videos, texts, and product descriptions, is the exclusive property of Peak Performance and is protected by applicable intellectual property laws. Any reproduction or use without prior written authorization is strictly prohibited.
ARTICLE 11 — PERSONAL DATA & PRIVACY
Peak Performance collects and processes personal data solely for the purpose of processing orders and managing customer relationships. Data is never sold to third parties.
Customers have the right to access, rectify, and request deletion of their personal data by contacting: peakperformance.commerce@gmail.com
ARTICLE 12 — GOVERNING LAW & DISPUTES
These conditions are governed by French law. In the event of a dispute, both parties will first attempt to resolve the matter amicably. If no resolution is reached, the dispute shall be submitted to the competent courts of France, unless otherwise required by mandatory local consumer protection laws in the customer’s country.
